Navigating Queensland's New Seller Disclosure Regime: What You Need to Know!

Starting 1 August 2025, Queensland's property landscape will undergo a significant transformation with the introduction of a mandatory Seller Disclosure Regime. This shift aims to enhance transparency and provide buyers with essential information upfront, moving away from the traditional 'buyer beware' approach.

Understanding the New Seller Disclosure Regime

Under the new legislation, sellers of both residential and commercial properties in Queensland are required to provide prospective buyers with a completed and signed disclosure statement, along with prescribed certificates, before the buyer signs the contract of sale. This applies to various sale methods, including private treaty, auction, and options to purchase.

Key Components of the Disclosure Statement:

• Seller and Property Details: Including the seller's name, property address, and lot-on-plan description.
• Title Details and Encumbrances: Information on registered and unregistered encumbrances, such as easements or leases.
• Land Use, Planning, and Environment: Details about zoning, planning schemes, environmental considerations like contamination or heritage listings.
• Buildings and Structures: Information on pool safety certificates, owner-builder work, and any notices from local authorities.
• Rates and Services: Most recent rates and water service charges applicable to the property.
• Community Titles or BUGTA Schemes: If applicable, details about the community management statement and body corporate certificate.

Prescribed Certificates May Include:

• A current title search and plan of survey.
• Relevant notices or orders from authorities concerning the property.
• Pool safety compliance certificate (if applicable).
• Body corporate certificate for properties in community titles schemes.

Implications for Sellers and Buyers

Failure to provide the disclosure documents correctly, or omissions relating to material matters, may entitle the buyer to terminate the contract at any time before settlement. This underscores the importance of accuracy and completeness in the disclosure process.
